Public Tender<\/b><\/a><\/p>\n<div id=\"hidden-1\" class=\"reveal-box is-hidden\">\n<p><span style=\"font-weight: 400;\">This is the standard procurement procedure, in which a <strong>public invitation<\/strong> is issued for any interested party to submit proposals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proposals are evaluated under <strong>fair<\/strong> and <strong>equitable<\/strong> conditions, based on technical, economic, and quality criteria, allowing broad supplier participation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This procedure ensures <strong>transparency<\/strong>, <strong>maximum competition<\/strong>, and the <strong>best possible conditions<\/strong> for the State Productive Enterprise.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><em>(Reference: Article 11, section I of the General Contracting Provisions)<\/em>.<\/span><\/p>\n<\/div>\n<p><a class=\"reveal-link\" href=\"#\" data-target=\"#hidden-2\"><b>2. Restricted Invitation<\/b><\/a><\/p>\n<div id=\"hidden-2\" class=\"reveal-box is-hidden\">\n<p><span style=\"font-weight: 400;\">This procedure involves inviting a <strong><em>limited number of pre-qualified suppliers<\/em><\/strong> when a public tender is not deemed suitable or feasible due to market conditions or the specific nature of the requirement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It aims to balance <strong>process efficiency<\/strong> with the need to obtain competitive conditions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><em>(Reference: Article 11, section II of the General Contracting Provisions)<\/em>.<\/span><\/p>\n<\/div>\n<p><a class=\"reveal-link\" href=\"#\" data-target=\"#hidden-3\"><b>3. Direct Award<\/b><\/a><\/p>\n<div id=\"hidden-3\" class=\"reveal-box is-hidden\">\n<p><span style=\"font-weight: 400;\">This procedure is used <strong><em>without a competitive bidding process<\/em><\/strong>, when specific conditions established in the applicable regulations are met.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In accordance with Articles 11, 29, 30, and 31 of the General Contracting Provisions, <strong>direct awards may apply<\/strong> in the following scenarios:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400; margin-bottom: 0.6em;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Emergency situations<\/strong>, force majeure, or unforeseen events that threaten safety, the environment, or operational continuity.<\/span><\/li>\n<li style=\"font-weight: 400; margin-bottom: 0.6em;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Procurement of <strong>highly specialized goods or services<\/strong> not widely available in the market.<\/span><\/li>\n<li style=\"font-weight: 400; margin-bottom: 0.6em;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Existence of a <strong>sole supplier<\/strong> or <strong>exclusive rights<\/strong>, duly documented through official certification.<\/span><\/li>\n<li style=\"font-weight: 400; margin-bottom: 0.6em;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Low-value contracts<\/strong> within the thresholds established by internal regulations, provided there is no improper contract splitting.<\/span><\/li>\n<li style=\"font-weight: 400; margin-bottom: 0.6em;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Cases justified<\/strong> on technical, operational, or strategic grounds, as validated by the relevant internal authorities.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"><br \/>\nIn all cases, a direct award requires <em>formal justification, validation<\/em> by the <strong>Procurement and Supply area<\/strong>, and strict compliance with the <strong>principles<\/strong> of <strong>efficiency<\/strong>, <strong>transparency<\/strong>, and administrative accountability.<\/span><\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Petr\u00f3leos Mexicanos (PEMEX), Mexico&#8217;s state-owned oil company, follows a procurement process governed by specific laws and regulations due to its nature as a public entity.
